Warranty Policy

This voluntary commercial guarantee policy outlines the terms and conditions under Foundry Distribution (“Nitro”) provides commercial guarantee coverage for:

  • Nitro Snowboards
  • Nitro Snowboard Boots
  • Nitro Snowboard Bindings
  • Nitro Accessories

1. Application

This commercial guarantee policy applies to products either purchased on www.nitrosnowboardsusa.com or through an authorized dealer.

2. Commercial Guarantee Coverage

Nitro guarantees to the original purchaser that new and unused Nitro snowboards, bindings and boots are free from defects in materials and workmanship, under normal and intended use.

This commercial guarantee is only valid for the original purchaser and is not transferable.

3. Commercial Guarantee Period

All inline Nitro snowboards, bindings and boots manufactured during or after production year 2022/2023 are covered by a commercial guarantee period of two (2) years from the original date of purchase.

All rental Nitro snowboards, bindings and boots are covered by a commercial guarantee for a period of three (3) years from the date of production, limited to production year 2022/2023 and after.

All products produced prior to 2022/2023 are not covered by a commercial guarantee. This does not affect your statutory rights under applicable consumer protection laws.

4. Submitting and Processing a Claim

Purchased your goods on the official US Nitro online store? Then submit your claim directly via this form: https://www.nitro-dealer.com/copy-of-warranty-submission

Purchased your goods from an authorized dealer? Then please first contact the dealer from where you bought your product and follow their claim procedure. Once your claim is submitted to the dealer the claim will then be processed through our international warranty system. The outcome of your claim and the solution will then be communicated to you through the dealer.

Important: You must submit a valid proof of purchase. Without it, your claim may be denied.

5. What Nitro Does in the event of a defect

For inline products, if after inspection by Foundry Distribution or the authorized dealer, your product is determined to be defective it will either be repaired or replaced at the discretion Foundry Distribution. or the retailer – depending on the type of defect and product availability.

Repaired or replaced products are only covered for the remaining duration of the original commercial guarantee period.

For rental products, if after inspection by Foundry Distribution or our authorized dealer your product is determined to be defective, it will be repaired or replaced at the discretion of Foundry Distribution. or our authorized distributor. In the event a replacement is not available, a credit will be issued with the following scale:

  • Within the 1st year of production – 100% of the product’s value
  • Within 2 years of production – 60% of the product’s value
  • Within 3 years of production – 30% of the product’s value

6. Return shipping cost of claims

In the event of a valid commercial guarantee claim or a defect covered by statutory warranty rights, the customer shall bear the reasonable costs of returning the goods to Foundry Distribution, if the products were purchased on www.nitrosnowboardsusa.com. The repaired or replacement products to the customer will be borne by Foundry Distribution.

For customers who have purchased their products from www.nitrosnowboardsusa.com but do not reside in USA, the customer will be required to pay any customs and duties.

Products purchased from an authorized dealer and distributor are subject to the dealers and distributors shipping terms.

7. Exclusions from Coverage

The commercial guarantee does not cover damages caused by:

  • Misuse, abuse, neglect, or accidents
  • Normal wear and tear from riding
  • Improper mounting, adjustment, or installation of bindings
  • Use of solvents or thread locking adhesives on bindings or inserts
  • Use of non-Nitro hardware for binding mounting
  • Impact or abrasion with non-snow surfaces (chairlifts, rocks, rails, stairs, snowboard edges, etc.)
  • Any reason other than a defect in materials or workmanship
  • Boot damage caused by protruding elements or mechanisms on non-Nitro bindings

8. Commercial Guarantee Conditions

The commercial guarantee is void if there are any modifications or alterations of the original product.

9. Limitation of Liability

This guarantee does not cover any incidental or consequential cost, losses or damages.

This limitation does not affect your statutory rights under applicable consumer protection laws, nor does it apply in cases of damages caused intentionally or by gross negligence.

10. Supplement to your statutory rights

This commercial guarantee does not affect your statutory right of withdrawal and statutory legal guarantee rights under applicable national laws relating to the sale of consumer goods. These statutory rights are neither restricted nor replaced by this commercial guarantee.

11. Glossary if Terms:

Inline: means tangible products that are sold or otherwise permanently transferred to the end consumer as part of Nitro’s standard product portfolio and that are not provided under a rental, lease, loan, subscription, or other temporary-use arrangement.

Production year: The year in which the product was produced at the manufacturing facility. The date of production of all products can be found in the following places:

  • Nitro snowboards – Stamped into the top sheet of the board
  • Nitro boots – On the label inside of the tongue
  • Nitro bindings – Stamped into the baseplate under the gas pedal.

Accessories: Items manufactured by Nitro as part of our inline products collection which are neither a snowboard, snowboard boot, or snowboard binding. This includes products such as skins, telescopic and folding poles, board bags and packs.
